These Terms of Service ("Terms") govern your access to and use of the website (theathletesdietitian.com.au), any associated web or mobile application ("App"), and the telehealth sports dietetics and nutrition services ("Services") provided by OMA Health Pty Ltd, trading as The Athlete's Dietitian ("we", "us" or "our"). By creating an account, booking a consultation, or otherwise using our Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use our Services.

Our practitioners are Accredited Practising Dietitians (APD) and/or Registered Sports Dietitians credentialed through Dietitians Australia. Dietetics is not a profession registered under the Health Practitioner Regulation National Law administered by the Australian Health Practitioner Regulation Agency (AHPRA); our practitioners are instead bound by the Dietitians Australia Code of Conduct, Scope of Practice and Standards of Practice, and by the relevant state or territory unregistered health practitioner complaints scheme described in section 15.
2. Nature of Our Services
We provide individualised sports nutrition and dietetic consultations, meal planning, body composition and performance nutrition coaching, gut health support and related education, delivered primarily via telehealth (video or phone consultation) to clients across Australia.
Not emergency or diagnostic services. Our Services are not designed for, and must not be used for, medical emergencies or the diagnosis or treatment of acute medical conditions. If you are experiencing a medical emergency, or are at risk of harm to yourself or others, call 000 (emergency services) immediately, or contact Lifeline on 13 11 14. Our dietitians do not diagnose medical conditions, prescribe medication, or replace the care of your general practitioner or treating medical specialists. We may recommend that you see, or continue to see, a general practitioner or other qualified professional where appropriate, and where relevant we will encourage or require a referral before providing certain services (for example, under a Medicare Chronic Disease Management plan).
3. Eligibility and Your Account
You must provide accurate, current and complete information when creating an account or booking a consultation, and keep that information up to date.
If you are under 18 years of age, a parent or legal guardian must provide consent for you to receive our Services and must accept these Terms on your behalf, unless we are satisfied it is appropriate to rely on your own consent given your age and maturity.
You may create or access an account using "Sign in with Google." You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use.
We may suspend or terminate your account if information you provide is false, misleading, or if you breach these Terms.
4. Telehealth Consultations
By booking a telehealth consultation, you acknowledge and consent to the following:
Telehealth relies on technology (internet connection, camera, microphone and video-conferencing software) that may occasionally fail, and consultations may need to be rescheduled or continued by phone if technical issues arise.
You are responsible for ensuring you are in a private, safe location with adequate connectivity for your consultation.
We do not record video or audio consultations unless we separately ask for, and you give, your express consent.
Telehealth may not be appropriate for all conditions or circumstances. Your practitioner may recommend an in-person review with an appropriate practitioner where clinically necessary.
Advice provided during a consultation is based on the information you provide. It is your responsibility to disclose complete and accurate health, medical and dietary information; incomplete or inaccurate information may affect the appropriateness of the advice given.
5. Scope of Dietetic Advice
Our dietitians provide advice and recommendations tailored to the information you provide at the time of your consultation. Nutrition and health needs can change, and advice given at one point in time may not remain appropriate — you should seek an updated consultation if your circumstances change. Individual results from following our advice or programs (including in relation to performance, body composition or health outcomes) vary and are not guaranteed. Our Services are not a substitute for independent medical advice, and you should consult your general practitioner or relevant specialist about any medical concerns.
6. Bookings, Cancellations and Fees
Consultation fees are as advised at the time of booking and are payable in accordance with our published fee schedule or as otherwise agreed.
Cancellations or reschedules made with less than 24 hours' notice, or missed appointments ("no-shows"), may incur a cancellation fee, as advised at the time of booking.
Refunds are considered on a case-by-case basis and in accordance with your rights under the Australian Consumer Law (see section 12).
Where you purchase a program or package of multiple sessions, the specific terms (including validity periods and any non-refundable components) will be provided to you at the time of purchase and form part of these Terms.
7. Medicare and Private Health Fund Rebates
Where you wish to claim a Medicare rebate (for example, under a GP Chronic Disease Management/Team Care Arrangement referral) or a private health fund ancillary/extras benefit for our Services:
You are responsible for confirming your own eligibility for any Medicare item number or health fund rebate before your appointment. We do not guarantee that any rebate will be available or approved.
You authorise us to disclose the minimum necessary information (such as your name, Medicare number, referral details, and details of the service provided) to Medicare/Services Australia or your private health fund solely for the purpose of processing your claim.
You remain responsible for the full consultation fee if a claim is rejected, or if you do not hold a valid referral or fund membership at the time of service.
8. Your Responsibilities
Provide honest, complete and up-to-date information about your health, medical history, medications and circumstances.
Use the Services lawfully and only for your own personal, non-commercial health and nutrition purposes, unless we agree otherwise in writing.
Seek urgent or emergency care from an appropriate service (see section 2) rather than relying on our Services.
Not use our Services, website or App in a way that infringes any law, or the rights of us or any third party.
9. Intellectual Property
All content we provide as part of the Services — including meal plans, nutrition programs, written resources, videos, website and App content and branding — is owned by or licensed to OMA Health Pty Ltd and is protected by copyright and other intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use this content for your own personal use. You must not reproduce, resell, distribute or publicly share our content without our prior written consent.
10. Prohibited Conduct
You must not:
Impersonate another person or misrepresent your identity or health information.
Attempt to gain unauthorised access to our systems, accounts or data, or interfere with the operation of our website or App.
Use our Services for any unlawful, harmful, abusive or fraudulent purpose.
Share your account access with another person.
11. Third-Party Services and Links
Our website and App may use or link to third-party services, including Google Sign-In, payment processors, telehealth platforms and analytics providers. Your use of these third-party services is subject to their own terms and privacy policies, and we are not responsible for their content, functionality or practices.
12. Liability, Warranties and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified. To the extent permitted by law, and subject to the foregoing:
Our Services are provided with reasonable care and skill, but we do not warrant that outcomes (including specific health, performance or body composition results) will be achieved.
We are not liable for any indirect, special or consequential loss arising from your use of the Services, or from any interruption, technical failure, or unavailability of our website, App or telehealth platform.
Where we are found liable for a failure to comply with a non-excludable consumer guarantee in relation to services, our liability is limited (at our option, and where permitted by law) to resupplying the services or paying the cost of having the services resupplied.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from any claim, loss, liability or expense (including reasonable legal costs) arising out of your breach of these Terms, your misuse of the Services, or your provision of false or misleading information to us.
14. Suspension and Termination
You may stop using our Services or close your account at any time by contacting us. We may suspend or terminate your access to the Services or App, with or without notice, if we reasonably believe you have breached these Terms, engaged in unlawful conduct, or if we cease to offer the Services. Termination does not affect any accrued rights or obligations, including any fees already owing, and our record-keeping and privacy obligations regarding your health information will continue to apply as described in our Privacy Policy.
15. Complaints and Regulatory Bodies
If you are dissatisfied with our Services or wish to raise a concern about a practitioner's conduct, please contact us first at info@theathletesdietitian.com.au so we can seek to resolve the matter. If you remain unsatisfied, you may contact:
Your relevant state or territory unregistered health practitioner complaints body — for example the Health Complaints Commissioner (Victoria), the Health Care Complaints Commission (NSW), the Office of the Health Ombudsman (Queensland), the Health and Community Services Complaints Commissioner (SA), the Health and Disability Services Complaints Office (WA), or the equivalent body in your state or territory.
Dietitians Australia — regarding an Accredited Practising Dietitian's compliance with its Code of Conduct.
Office of the Australian Information Commissioner (OAIC) — for privacy-related complaints.
Australian Competition and Consumer Commission (ACCC) or your state fair trading body — for consumer law matters.
16. Privacy
Our collection, use, storage and disclosure of your personal and health information is governed by our Privacy Policy, available at theathletesdietitian.com.au, which forms part of these Terms.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, technology or legal obligations. The "Last updated" date above shows when these Terms were last revised. Continued use of our Services after changes take effect constitutes acceptance of the updated Terms. Where changes are significant, we will take reasonable steps to notify you.
